JLCNY STATEMENT REGARDING THE RESIGNATION OF  DR. NIRAV SHAH FROM THE NYS DEPARTMENT OF HEALTH


BINGHAMTON – April 10, 2014 - Dan Fitzsimmons, President of the Joint Landowners Coalition of New York said: “We wish Dr. Shah well in his new position with Kaiser Foundation Health Plan in California although we are deeply disappointed that he has not completed his health review on high volume hydraulic fracturing.  The State and Dr. Shah appear to have other priorities that do not include the revitalization of our dying communities in the Marcellus shale region.  The health impacts of poverty and unemployment seem to be of no concern to our state leaders. Rest assured that Dr. Shah’s departure will have no impact on our lawsuit to compel the State to complete the SGEIS.” “New York has been waiting 19 months for Dr. Shah to complete his health review even though DOH concluded in a Health Report from February 2012 that any health risks associated with HVHF would be preventable under the proposed guidelines set forth in the Revised Draft SGEIS and that “significant adverse impacts on human health are not expected from routine HVHF operations. In September 2012 DEC Commissioner Martens formally requested that Commissioner Shah and the DOH perform a DOH review. On February 12, 2013, Commissioner Shah sent a letter to Commissioner Martens stating: “I anticipate delivering the completed Public Health Review to you within a few weeks, along with my recommendations.  14 months have gone by since Dr. Shah stated he would complete his review in a “few weeks”.  Meanwhile, New York remains on the sidelines during one of our nation’s most significant energy revolutions.”
