Binghamton, NY (WBNG Binghamton) The Joint Landowners Coalition of New York says there is more good news for supporters of natural gas development here in New York.

Federal Judge Nicholas Garaufis has just dismissed a lawsuit that could have prevented hydro-fracking in the Delaware River Basin.

The lawsuit was originally brought by New York Attorney General Eric Schneiderman.

JLCNY President Dan Fitzsimmons said this action is one step closer to moving forward with natural gas development in New York.

"It also sends a message to Albany," said Fitzsimmons. "It's a really good message that you can't base these things, that public policy shouldn't be based, or health studies, on speculation and what ifs or what could be. It needs to be based on facts and science, and that's what we need to see."

Fitzsimmons said he hopes the New York DEC finalizes permitting regulations soon so that upstate New York can move ahead with natural gas development.

The DEC has directed the State Health Commissioner to conduct a review of its analysis in public health and safety first.
