As a result of Governor Cuomo's mandate that the state provide billions of taxpayer dollars in subsidies for renewable energy development, many landowners have received offers to lease their land for wind farms.
As with any first offer of an industry lease, these leases do not have the best financial terms nor do they provide the landowner protections necessary for long term lease deals that could last 30 – 40 years.
Landmen throughout the state are soliciting landowners in specific wind development areas. We have heard that some landowners have signed the first wind offer with few or no changes to the industry favored lease. And, many of these leases fail to protect a landowner’s oil, gas and mineral rights.
Please do not put yourself and your property at risk without seeking the assistance of a competent attorney experienced with wind farm negotiations.
As we have said since unscrupulous landmen first came to our areas years ago, if approached with such an offer DO NOT SIGN ANYTHING WITHOUT CONSULTING AN ATTORNEY QUALIFIED AND EXPERIENCED IN DEALING WITH SUCH MATTERS.
